CREW EATS TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By accessing or using the Crew Eats mobile application and related services (the "Service"), you ("User," "you," or "your") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Crew Eats Inc., a Georgia corporation ("Crew Eats," "we," "us," or "our").

2. DESCRIPTION OF SERVICE

2.1 Service Overview

Crew Eats provides a mobile application platform that enables airline crew members and authorized airport personnel to:

  • Order food from airport restaurants and vendors
  • Schedule delivery to secure airport areas
  • Arrange pickup from restaurant locations
  • Manage payment methods
  • Track order status and delivery progress

2.2 Service Availability

  • The Service is launching at select airports; availability is announced in the app
  • Operating hours vary by location and restaurant
  • Service may be temporarily unavailable due to security restrictions, weather, or operational constraints

2.3 Eligibility Requirements

To use the Service, you must:

  • Be at least 18 years of age
  • Be an active airline crew member, airport employee, or authorized personnel
  • Provide valid crew identification or employment verification
  • Have access to secure airport areas (where applicable)
  • Maintain an active payment method

3. USER ACCOUNTS

3.1 Account Registration

  • You must create an account to use the Service
  • All registration information must be accurate and current
  • You are responsible for maintaining account confidentiality
  • You must promptly update account information when it changes
  • One account per person is permitted

3.2 Account Security

  • You are solely responsible for account activity
  • You must use a secure password and protect login credentials
  • You must immediately notify us of unauthorized account access
  • We may suspend accounts suspected of unauthorized use

3.3 Account Termination

We may terminate or suspend your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Failure to pay outstanding charges
  • Inactivity for more than 12 months
  • Any reason at our sole discretion with 30 days' notice

4. ORDERING AND PAYMENT

4.1 Order Placement

  • Orders may be placed in real-time or scheduled in advance
  • All orders are subject to restaurant availability and approval
  • Order confirmation does not guarantee fulfillment
  • Flight information may be required for delivery coordination
  • Special dietary requirements and allergies must be specified

4.2 Pricing and Fees

  • Menu Prices: Set by individual restaurants and subject to change
  • Delivery Fees: If any, shown before you place the order
  • Service Fees: May apply to orders below minimum thresholds
  • Commission: Included in menu prices paid to restaurants
  • Tips: Optional and passed on to delivery personnel
  • Taxes: Applied as required by applicable law

4.3 Payment Processing

  • Payment is processed through Stripe and other authorized processors
  • We accept major credit cards, debit cards, and digital payment methods
  • Payment is charged upon order confirmation
  • Automatic payment retry may occur for failed transactions
  • All transactions are processed in U.S. dollars

4.4 Subscriptions

Crew Eats does not currently offer subscription plans. If we introduce them, we will publish subscription terms — including renewal, cancellation and refund rules — before anyone can enroll, and enrollment will require your affirmative consent.

5. ORDER CANCELLATION AND REFUNDS

5.1 Cancellation Policy

  • Before Preparation: Orders may be cancelled without charge before restaurant begins preparation
  • After Preparation: Cancellation may result in full charge with no refund
  • System Issues: Orders cancelled due to app or system failures will be fully refunded
  • Flight Changes: Cancellation due to flight delays or changes will be handled case-by-case

5.2 Refund Policy

Refunds are provided in the following circumstances:

  • Order cancelled by restaurant before preparation
  • Delivery failure due to Crew Eats error
  • Significant order errors or quality issues
  • System errors resulting in duplicate charges
  • Service unavailability after payment processing

5.3 Refund Process

  • Refunds are issued to the original payment method
  • Processing time: 3-5 business days for credit cards
  • Refund amounts exclude non-recoverable fees (e.g., payment processing)
  • Disputes must be reported within 24 hours of delivery/pickup

6. DELIVERY AND PICKUP SERVICES

6.1 Delivery Service

  • Delivery available to designated secure areas at participating airports
  • Delivery times are estimates and not guaranteed
  • Access to secure areas requires proper authorization
  • Deliveries are made by dedicated CrewEats runners engaged through our contracted airport ground-services partner, badged through each airport's own security process and operating under CrewEats' direction
  • Contact information must be accurate for successful delivery

6.2 Pickup Service

  • Pickup available at participating restaurant locations
  • Pickup times coordinated with restaurant preparation
  • Valid identification required for order collection
  • Orders not collected within 30 minutes may be cancelled

6.3 Delivery Limitations

We are not responsible for delivery delays or failures due to:

  • Airport security restrictions or clearance delays
  • Flight schedule changes or gate modifications
  • Weather conditions or operational disruptions
  • Incorrect delivery information provided by user
  • User unavailability at specified delivery time

7. FOOD SAFETY AND QUALITY

7.1 Restaurant Responsibility

  • Restaurants are solely responsible for food preparation, quality, and safety
  • Restaurants must comply with all applicable health and safety regulations
  • Ingredient information and allergen warnings are provided by restaurants
  • We do not prepare, inspect, or guarantee food quality

7.2 User Responsibility

  • Users must provide accurate dietary restrictions and allergy information
  • Users should inspect orders upon receipt
  • Food safety concerns must be reported immediately
  • Users consume food at their own risk

7.3 Quality Issues

For food quality concerns:

  • Contact customer support within 24 hours
  • Provide specific details about the issue
  • Refunds or credits may be provided at our discretion
  • We will work with restaurants to address systemic issues

8. INTELLECTUAL PROPERTY

8.1 Crew Eats Property

The Service and all content, including but not limited to:

  • Software, technology, and algorithms
  • Trademarks, logos, and branding
  • Text, graphics, images, and videos
  • User interface and design elements

Are owned by Crew Eats or our licensors and protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8.3 Prohibited Uses

You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile the software
  • Remove or alter proprietary notices
  • Use our intellectual property without permission
  • Use the Service for commercial purposes without authorization

9. USER CONDUCT

9.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to systems
  • Interfere with or disrupt the Service

9.2 Prohibited Activities

  • Creating false accounts or impersonating others
  • Sharing account credentials with unauthorized persons
  • Using automated systems to access the Service
  • Attempting to circumvent security measures
  • Engaging in fraudulent or deceptive practices

9.3 Content Standards

Any content you provide must:

  • Be accurate and not misleading
  • Respect the privacy and rights of others
  • Not contain illegal, harmful, or offensive material
  • Comply with applicable content guidelines

10. LIMITATION OF LIABILITY

10.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREW EATS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Personal injury or property damage
  • Flight delays or missed connections
  • Food-related illness or allergic reactions

10.3 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO CREW EATS IN THE 12 MONTHS PRECEDING THE CLAIM.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Crew Eats, its officers, directors, employees, agents, and partners from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of applicable laws or regulations
  • Your violation of the rights of others
  • Any content you provide through the Service

12. DISPUTE RESOLUTION

12.1 Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Nothing in these Terms takes away protections that the law of your home state or country gives you and does not allow to be waived by contract.

12.2 Talk to Us First

Before filing any claim, contact us at tech.team@creweats.com with a description of the dispute. Both sides agree to try in good faith to resolve it informally for 30 days from the date you contact us. Any applicable statute of limitations is paused (tolled) during this 30-day window, so talking to us first costs you no legal rights.

12.3 Small Claims Court

Either party may bring a qualifying individual claim in a small claims court of competent jurisdiction — including the one where you live — instead of the courts described below.

12.4 Courts and Venue

Except for small claims cases, any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state courts located in Bibb County, Georgia, or in the United States District Court for the Middle District of Georgia where that court has jurisdiction, and both parties consent to personal jurisdiction and venue there.

12.5 No Class Actions

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

If this waiver is found unenforceable as to a particular claim, it is severed as to that claim only, and the remainder of these Terms stays in effect.

12.6 What This Section Does Not Do

Nothing in this Section prevents either party from seeking emergency or injunctive relief from a court where the law allows it, prevents you from filing a complaint with a government agency, or waives any remedy that applicable law does not allow to be waived.

12.7 Changes to This Section

Any change to this Section applies prospectively only — it does not apply to disputes that arose before the change took effect.

13. FORCE MAJEURE

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, or severe weather
  • Government actions, laws, or regulations
  • Airport security incidents or restrictions
  • Labor disputes or strikes
  • Technical failures or cyber attacks
  • Public health emergencies

14. PRIVACY

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our privacy practices as described in the Privacy Policy.

15. MODIFICATIONS TO TERMS

15.1 Right to Modify

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting updated Terms in the app
  • Sending email notifications to registered users
  • Displaying prominent notices in the Service
  • Providing at least 30 days' advance notice for significant changes

15.2 Acceptance of Changes

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to changes, you must discontinue use of the Service.

16. SEVERABILITY

If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the original intent.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Crew Eats regarding the Service and supersede all prior agreements and understandings.

19. ACKNOWLEDGMENT

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS & CONDITIONS.
